Terms of service.

1. These terms

These terms are the agreement between you and Summerteez when you use summerteez.com or buy something from it. By browsing the site or placing an order you accept them. If you do not accept them, please do not order.

We can change these terms, and when we do we update the date at the top of this page. The version in force when you place an order is the version that governs that order, so a later change cannot be applied backwards to something you have already bought. Our privacy policy and shipping and returns policy form part of this agreement.

2. Who can order

You need to be 18 or older, or shopping with the involvement of a parent or guardian who accepts these terms on your behalf. We ship to addresses in the United States only, so orders are placed under and governed by US law.

3. Ordering and acceptance

Placing an order is an offer to buy, not a completed contract. The contract is formed when we email you to say the order has been dispatched. Until then, either side can walk away and nothing is owed.

We can decline or cancel an order, in whole or in part, and refund it in full. In practice this happens for one of four reasons: the item sold out between your order and our packing bench, the price or description was wrong, the order looks fraudulent, or the quantity is clearly for resale rather than for wearing. If we cancel, you get a full refund and an email explaining which of those it was.

Stock counts are kept as accurate as we can make them, but two people can order the last M within the same minute. If that happens we tell you the same day and refund immediately.

4. Pricing, tax and errors

Prices are in US dollars and exclude sales tax, which is added where the destination state requires it. Prices can change at any time, but never on an order already placed. Shipping charges are set out on the shipping and returns page.

Sometimes a price or a description is simply wrong, whether that is a typo, a currency slip or a fabric weight that does not match the garment. Where the error is obvious we are not required to sell at the wrong price. We will contact you, offer the item at the correct price, and cancel and refund in full if you would rather not proceed. We do not treat a mistake on our side as your problem.

5. Shipping and risk of loss

Delivery times quoted on the site are estimates from the carrier and are not guarantees, though we do guarantee when the parcel leaves us. Risk of loss and damage stays with us until the parcel is delivered to the address you gave. If it does not arrive or arrives damaged, we replace it or refund you. If the address you gave was wrong and the parcel comes back to us, we will resend it once at no charge.

6. Returns and exchanges

Thirty days from delivery, unworn and unwashed with the tags on, free return label, refunded to the original payment method within 5 business days of the parcel reaching us. One free size exchange per order. Faulty or wrong items are replaced at our cost on the strength of a photo, with nothing to send back. The full detail, including how to start a return, is on the shipping and returns page, which forms part of these terms. Nothing here limits any right you have under federal or state consumer law.

7. Our designs and this site

The artwork printed on our tees, the product photography, the copy on this site and the Summerteez name and wordmark belong to us and are protected by copyright and trademark law. Buying a tee buys you the tee. It does not transfer any rights in the design printed on it.

You are welcome to:

• Wear it anywhere, including at work, on camera and in your own photos.
• Post photos of yourself wearing it, tagged or untagged.
• Resell or give away the physical tee you bought.

Please do not:

• Reproduce a design on any other product, whether or not you sell it.
• Use our artwork, photography or wordmark in your own branding, packaging or advertising.
• Copy our product photography or product copy onto a marketplace listing or another shop.

If you want to use something of ours, ask. We are reasonable about it, and if we think a design of ours has been lifted we will say so directly before anyone involves lawyers.

8. Acceptable use

Use the site to look at tees and buy them. Do not attempt to break into it, probe it for vulnerabilities, scrape it at volume, place automated or bot driven orders, use a payment method that is not yours, or interfere with anyone else who is using it. Do not upload or send anything unlawful, threatening or knowingly false. We can suspend access or cancel orders where any of that is happening, and we will refund anything already paid for goods we do not ship.

9. Accounts

If you create an account, keep your password to yourself and tell us if you think somebody else has it. You are responsible for what happens under your account until you tell us. You can close it whenever you like by emailing us, and we will delete it within 30 days, keeping only the order records we are legally required to hold.

10. Feedback and anything you send us

If you send us an idea for a design, a suggestion or a bug report, we can use it without owing you anything and without confidentiality. That is not us trying to take your work, it is us avoiding the situation where an idea we were already sketching turns into a dispute. If you have artwork you genuinely want to license to us, say so in the email and we will treat it as a proposal rather than as feedback.

11. What we do not promise

The site is provided as it is. We do not promise it will be available without interruption or entirely free of errors. Colours on a screen are an approximation and two screens rarely agree, so a garment colour may look different in person, and printed cotton varies slightly from run to run. Except where these terms say otherwise, and to the extent the law allows, we disclaim implied warranties of merchantability and fitness for a particular purpose. Some states do not allow those exclusions, in which case they do not apply to you.

12. Limitation of liability

To the extent permitted by law, Summerteez is not liable for indirect, incidental, special or consequential losses, including lost profits, lost data or lost opportunity, arising out of your use of the site or of the products. Our total liability for any claim connected to an order is limited to the amount you paid for that order.

Nothing in these terms limits liability for fraud, for personal injury or death caused by negligence, or for anything else that cannot lawfully be limited. Some states do not allow the exclusion of incidental or consequential damages, so this section may not apply to you in full.

13. Governing law and disputes

These terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict of law rules. Any dispute that cannot be resolved between us will be handled by the state or federal courts sitting in California, and both sides consent to that.

Before any of that, email us. Almost everything that looks like a dispute at ten in the morning is a replacement tee by lunchtime. We commit to trying to sort out any complaint informally for 30 days before either side files anything.

14. General

If any part of these terms is found to be unenforceable, the rest of them still apply. If we do not enforce something straight away, that is not us giving up the right to enforce it later. You may not transfer your rights under these terms to somebody else without our agreement. We may transfer ours if the business is sold, in which case your rights are unchanged. These terms, together with the privacy policy and the shipping and returns policy, are the entire agreement between us about the subject they cover.
